Trump Tweets ‘Activated’ Photo of SCOTUS Justice Coney Barrett as the High Court Takes On Texas Election Case

Just as news broke that the Supreme court has docketed the case filed by Texas Attorney General Ken Paxton earlier today, President Trump took to twitter to retweet a memetic photo of SCOTUS Amy Coney Barrett that can only symbolize one thing: the president is confident in what Texas is doing.

The retweet from Trump shows a pictures of Barrett with the “activiation” eyes, which in realm of internet meme’s is a symbol that action is ready to be taken.

“They got caught because we were leading by so much more than they ever thought possible. Late night ballot “dumps” went crazy!” the President wrote.

As PFW reported earlier, Texas Attorney General Ken Paxton had filed a lawsuit against Georgia, Michigan, Pennsylvania, and Wisconsin in the United States Supreme Court claiming that the states had exploited the COVID-19 pandemic to justify ignoring state law and federal constitutional standards in the 2020 election.

Just twelve hours after it was filed on Tuesday, the Supreme court docketed the case, meaning the case will be heard before the court.

AG Paxton charged in a Tuesday press release that the four states “exploited the COVID-19 pandemic to justify ignoring federal and state election laws” and unlawfully enacted “last-minute changes, thus skewing the results of the 2020 General Election.”

As the AG explains in the press release, elections for federal office must comport with federal constitutional standards and each state much abide by the Electors Clause which requires state legislators to set the rules governing the appointment of electors and elections. What is delegated to the state legislator cannot be carried out by local officials as Paxton charges was the case within the states named in his suit.

The suit asks the Supreme Court to prohibit the counting of the Electoral College votes cast by the four states. And as for the states that have already picked electors, the lawsuit asks the court to direct the state legislatures to appoint new electors in line with the Constitution.

Additionally, the state of Texas is arguing that the differences in voting rules and procedures in different counties within the states violated the Constitution’s Equal Protection Clause.
