A federal judge in Texas has temporarily blocked the Biden administration order placing a 100 day freeze on deporting people inside the U.S. illegally.

U.S. District Judge Drew Tipton issued the block sought in a suit filed last week by Texas Attorney General Ken Paxton. The suit alleges Biden’s order is unconstitutional and violates an agreement between the Department of Homeland Security and Texas.

Judge Tipton argued that the Biden administration had failed “to provide any concrete, reasonable justification for a 100-day pause on deportations.”

The Judge’s order will be in place for 14 days as the state of Texas and the Biden admin. further litigate the issue.

On Twitter, AG Paxton proclaimed it was “VICTORY” for Texas to be the first state to win a lawsuit against the Biden administration.

“Within 6 days of Biden’s inauguration, Texas has HALTED his illegal deportation freeze. This was a seditious left-wing insurrection. And my team and I stopped it,” Paxton said.

In a complaint filed Friday, Paxton said the state of Texas would face “irreparable harm” if the deportation freeze was allowed to go into effect.

“The Court’s decision to stop the Biden Administration from casting aside congressionally enacted immigration laws is a much-needed remedy for DHS’s unlawful action,” Paxton said Tuesday, further adding:

“A near-complete suspension of deportations would only serve to endanger Texans and undermine federal law … Blatantly illegal security threats cannot be allowed to stand, and the rule of law must be upheld. I commend the Court for prioritizing the law and safety of our citizens, and I will continue to defend Texas against the unlawful and unconstitutional actions of President Biden and his Administration.”

President Biden signed the freeze last week as part of the blizzard of executive orders signed in his first few days in office.

Biden made it immediately clear upon taking office that his administration would send a package to Congress to provide a pathway to citizenship for some 11 million illegal immigrants, a move which can only be described as an about-face to the immigration policies of the Trump administration.

Further reversing Trump era decisions, Biden signed an order last week pausing construction of the now 450 mile long wall at the southern border.
