Six States Formally Join Texas’ Supreme Court Lawsuit Against Battleground States
17 states in total have filed amicus briefs with the court in support of Texas’ lawsuit.
Six additional states have formally joined the lawsuit filed by Texas Attorney General Ken Paxton at the Supreme court which challenges the constitutionality of election results in four battleground states.
A Thursday press release from Paxton explains that Missouri, Arkansas, Louisiana, Mississippi, South Carolina and Utah have signed on to suit that alleges Pennsylvania, Wisconsin, Michigan, and Georgia used the COVID-19 pandemic to conduct unconstitutional practices during the 2020 election.
“Texas continues to lead the fight to protect election security and integrity, and today I gladly welcome Missouri, Arkansas, Louisiana, Mississippi, South Carolina and Utah to this historic endeavor. By flouting state and federal election laws, the defendant battleground states have tainted the integrity of citizens’ votes across the entire nation,” Paxton said in the release.
“To restore trust in the integrity of our election process, we must tirelessly defend its security and hold accountable those who discarded our Constitution for their own convenience. Texas is proud to have these states by its side in shining the bright light of justice.”
The suit, filed and docketed by the Supreme Court on Tuesday, claims that the four battleground states ignored the Electors Clause of the constitution by allowing local officials to set the rules governing the appointment of electors and the election.
The Electors clause specifically vests “state legislatures with plenary authority regarding the appointment of presidential electors,” something that was not considered by the states during the November 3rd election, according to Paxton.
Additionally, the lawsuit argues that the differences in voting rules and procedures in different counties within the four states violated the Constitution’s Equal Protection Clause.
“The defendant states exploited the COVID-19 pandemic to justify ignoring federal and state election laws and unlawfully enacting last-minute changes, thus skewing the results of the 2020 General Election.” Paxton’s press release read.
As of writing, 17 states, including Missouri, Alabama, Arkansas, Florida, Indiana, Kansas, Louisiana, Mississippi, Montana, Nebraska, North Dakota, Oklahoma, South Carolina, South Dakota, Tennessee, Utah and West Virginia, have filed amicus briefs with the court in support of Texas’ lawsuit.
With the case now docketed, the four states named in the suit have been ordered to file their responses by 3 PM eastern time on Thursday.
